The California State Library believes the data is accurate and properly functioning, however, the State Library disclaims any responsibility for its accuracy or functionality. The data is provided on an “AS IS,” “AS AVAILABLE” and “WITH ALL FAULTS” basis. The State Library makes no warranties, express or implied, including but not limited to any warranties of merchantability or fitness for a particular purpose, with respect to the data.

Liability Disclaimer

In no event shall the State Library, its officers, elected officials, employees, representatives, or agents (collectively “the State Library”) become liable to users of the data, or any other party, for any loss or damages, consequential or otherwise, including but not limited to time, money, or goodwill, arising from the use, operation or modification of the data. In using the data, the user further agrees to indemnify, defend, release, and save harmless the State of California, the California State Library and its officers, employees, and agents, from any and all claims, losses, and liabilities accruing or of any nature arising out of or resulting from the lack of accuracy or correctness of the data, or the use of the data. Users assume the risk of using these materials and shall have no remedy at law or equity against the State Library in case the materials provided are inaccurate, incomplete or otherwise defective.

The user agrees to release the State Library from any liability of any nature whatsoever for any claim or injury or for damages or equitable or declaratory relief of any kind, whether the claim or any facts on such claim might be based, is known or unknown to the party possessing the claim.

Disclaimer of Duty to Continue Provision of Data

Due to the dynamic nature of the internet, the location of items may change as menus, homepages, and files are reorganized. The user expressly agrees that use of the data and materials is at the user’s sole risk. The State Library does not warrant that the service will be uninterrupted or error free. Changes are periodically added to the data and made to the overall structure of the website, content, and applications contained therein. The library may make improvements and/or changes to the data and materials at any time.

Data Warranty Disclaimer

The State Library strives to ensure that published materials are accurate, but makes no warranty, representation or guaranty of any type as to the content, accuracy, timeliness, completeness or fitness for any particular purpose or use, nor shall any such warranty be implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. All warranties are specifically disclaimed.

Limitations on Use of the Data

The public data gathered and developed by the California State Library may be used for research, engage public participation in government, inform decision-making, increase transparency, private study, teaching, criticism, news reporting, or comment. The data and materials are freely available, machine-readable, and formatted according to national technical standards to facilitate visibility and reuse of published data. The data should be easily retrieved, combined, downloaded, sorted, searched, analyzed, redistributed and re-used by individuals, business, researchers, journalists, developers, and government to process, trend, and innovate. Please credit the California State Library as the source of the data.

Users should be aware that the data maintained by the State Library meets various accuracy standards and is developed for a variety of different purposes. Some data does not meet National Map Accuracy Standards at scales finer than 1:24,000 in which cases any attempt to represent the data at finer scales will introduce positional error. Users shall review and understand the associated metadata, adhere to the use limitations provided herein, and contact the State Library with any questions that arise at crb@library.ca.gov. The State Library shall not be attributed as the source of the data when representing the data at scales below the absolute scales set for each dataset or when using the data outside of the limitations provided.
